There is no general rule for determining “bushi”.

The one thing I see with this is that the Hiruma Scout aren't tagged as bushi, but in the character creation example they allow a Hiruma Scout to purchase striking as Earth. Kata unless they are otherwise specialized cannot be purchased by non-bushi schools. This leads to a conflict in the rules.
What's worse is that they made several kata for the Lying Darkness followers in the Hidden Emperor book. They aren't bushi either.

The Tamori already have a kata in third Ed.
The rule isn’t only bushi can use kata period moving on.
It is that the insight rank requirement of general kata only counts bushi schools ranks unless otherwise noted. In many cases, Ninja / Tamori Shugenja is otherwise “noted”.
